Sura At‐Talaq
Sura At‐Talaq (Arabic: سورة الطلاق) (Divorce) is the 65th sura of the Qur'an in 28th part of the Quran with 12 ayat. It is Medinan sura.
سورہ الطلاق (الطلاق کے معنی طلاق) قرآن مجید کی 65 ویں سورت جس کے 2 رکوع میں 12 آیات ہیں۔ یہ 28 ویں پارہ میں ماجود مدنی سورت ہے
Name
At‐Talaq is not only the name of this Surah but also the title of its subject matter, for it contains commandments about Talaq (divorce) itself. Hadrat Abdullah bin Masud (ALLAH Bless Him) has described it as Surah An‐Nisa Al‐qusra (Arabic: سورۃ النساء القصریٰ) also Mean the shorter Surah An‐Nisa.
نام
اس سورت کا نام ہی الطلاق نہیں ہے، بلکہ یہ اس کے مضمون کا عنوان بھی ہے، کیونکہ اس میں طلاق ہی کے احکام بیان ہوئے ہیں۔ حضرت عبد اللہ بن مسعود رضی اللہ عنہ نے اسے سورۃ النساء القصریٰ بھی کہا ہے یعنی چھوٹی سورۂ نساء۔
Period of Revelation
Hadrat Abdullah bin Masud (ALLAH Bless Him) has Pointed out, and the internal evidence of the subject matter of the Surah confirms the same, that it must have been sent down after those verses of Surah Al‐Baqarah in which commandments concerning divorce were given for the first time. Although it is difficult to determine precisely what is its exact date of revelation, yet the traditions in any case indicate that when the people started making errors in understanding the commandments of Surah Al‐Baqarah, and practically also they began to commit mistakes, ALLAH sent down these instructions for their correction.In short it is Medinan Sura.
زمانۂ نزول
حضرت عبد اللہ بن مسعود رضی اللہ عنہ نے صراحت فرمائی ہے، اور سورت کے مضمون کے اندرونی شہادت بھی یہی ظاہر کرتی ہے کہ اس کا نزول لازماً سورۂ بقرہ کی اُن آیات کے بعد ہوا ہے جن میں طلاق کے احکام پہلی مرتبہ دیے گئے تھے۔ اگرچہ یہ تعین کرنا مشکل ہے کہ اس کا ٹھیک زمانۂ نزول کیا ہے لیکن بہرحال روایات سے اتنا ضرور معلوم ہوتا ہے کہ جب سورۂ بقرہ کے احکام کو سمجھنے میں لوگ غلطیاں کرنے لگے، اور عملاً بھی ان سے غلطیوں کا صدور ہونے لگا، تب اللہ تعالٰی نے ان کی اصلاح کے لیے یہ ہدایات نازل فرمائیں۔
Theme and Subject Matter
In order to understand the commandments of this Surah, it would be useful to refresh one's memory about the instructions which have been given in the Qur'an concerning divorce and the waiting period (Iddat) above.
"Women who are divorced have to wait for three monthly periods, and if they believe in God and the Last Day they must not hide unlawfully what God has formed within their wombs. Their husbands would do well to take them back in that case, if they wish to be reconciled. Women also have recognised rights as men have, though men have an edge over them. But God is all‐mighty and all‐wise". (Al Baqarah 228)
"Divorce is (revokable) two times (after pronouncement), after which (there are two ways open for husbands), either (to) keep (the wives) honourably, or part with them in a decent way. You are not allowed to take away the least of what you have given your wives, unless both of you fear that you would not be able to keep within the limits set by God. If you fear you cannot maintain the bounds fixed by God, there will be no blame on either if the woman redeems herself. Do not exceed the limits of God, for those who exceed the bounds set by God are transgressors".(Al Baqarah 229)
"If a man divorces her again (a third time), she becomes unlawful for him (and he cannot remarry her) until she has married another man. Then if he divorces her there is no harm if the two unite again if they think they will keep within the bounds set by God and made clear for those who understand." (Al‐Baqarah : 230)
"O you who believe, when you marry believing women then divorce them before having (sexual) contact with them, you have no right to demand observance of the 'waiting period' of them. But provide suitably for them, and let them go with honour." (Al‐Ahzab : 49)
"Wives of men who die among you should wait (after their husbands death) for four months and ten days; and when the term is over there is no sin if they do what they like with themselves honourably, for God is aware of all that you do."
(Al‐Baqarah 234)
The rules prescribed in these verses were as follows:
First, that the man who has been given the right to pronounce divorce should be taught such judicious methods of using this right as do not lead to separation, as far as possible however, if separation does take place, it should only be in case all possibilities of mutual reconciliation have been exhausted. For in the Divine Law provision for divorce has been made only as an unavoidable necessity; otherwise Allah does not approve that the marriage relationship that has been established between a man and a woman should ever break.
The Holy Prophet (Peace Be Upon Him) has said
"ALLAH has not made lawful anything more hateful in His sight than divorce." (Abu Daud).
And: "Of all the things permitted by the Law, the most hateful in the sight of ALLAH is the divorce, (Abu Daud)
The second object was to complement this section of the family law of Islam by supplying answers to the questions that had remained after the revelation of the commandments in Surah Al‐Baqarah. So, answers have been supplied to the following questions:What would be the waiting period of the women, marriage with whom has been consummated and who no longer menstruate, or those who have not yet menstruated, in case they are divorced? What would be the waiting period of the woman, who is pregnant, or the woman whose husband dies, if she is divorced?And what arrangements would be made for the maintenance and lodging of the different categories of divorced women, and for the fosterage of the child whose parents have separated on account of a divorce?

The rules prescribed in these verses were as follows:
- A man can pronounce at the most three divorces on his wife.
- In case the husband has pronounced one or two divorces he is entitled to keep the woman back as wife within the waiting period and if after the expiry of the waiting period the two desire to re‐marry, they can re- marry there is no condition of legalization (tahlil). But if the husband has pronounced three divorces, he forfeits his right to keep her as his wife within the waiting. period, and they cannot re‐marry unless the woman re‐marries another husband and he subsequently divorces her of his own free will.
- The waiting period of the woman, who menstruates and marriage with whom has been consummated, is that she should pass three monthly courses. The waiting period in case of one or two divorces is that the woman is still the legal wife of the husband and he can keep her back as his wife within the waiting period. But if the husband has pronounced three divorces, this waiting period cannot be taken advantage of for the purpose of reconciliation, but it is only meant to restrain the woman from re‐marrying another person before it comes to an end.
- There is no waiting. period for the woman, marriage with whom has not been consummated, and who is divorced even before she is touched. She can re‐marry, if she likes, immediately after the divorce.
- The waiting period of the woman whose husband dies, is four months and ten days.

موضوع اور مضمون
اس سورہ کے احکام کو سمجھنے کے لیے ضروری ہے کہ ان ہدایات کو پھر سے ذہن میں تازہ کر لیا جائے جو طلاق اور عدت کے متعلق اس سے پہلے قرآن مجید میں بیان ہو چکی ہیں
اَطَّلَاقُ مَرَّتٰنِ، فَاِمْسَکٌ ؍بِمَعْرُوْ فٍ اَوْتَسْرِیْح؍ٌ بِاِحْسِانٍ (البقرہ۔ 229) ’’طلاق دو بار ہے ، پھر یا تو سیدھی طرح عورت کو روک لیا جائے یا بھلے طریقے سے رخصت کر دیا جائے ‘‘
وَالْمُطَلَّقٰ تُ یَتَرَبَّصْنَ بِاَنْفُسِھِنَّ ثَلٰثَۃَ قُرُ وْ ءٍ۔۔۔۔۔ وَبُعُوْلَتُھُنَّ اَحَقُّ بِرَدِّ ھِنَّ فِیْ ذٰلِکَ اِنْ اَرَادُوْ ا اِصْلَا حاً (البقرہ۔ 228 )۔ ’’ اور مطلقہ عورتیں (طلاق کے بعد ) تین حیض تک اپنے آپ کو روکے رکھیں۔۔۔۔۔۔۔اور ان کے شوہر اس مدت میں ان کو (اپنی زوجیت میں ) واپس لے لینے کے حق دار ہیں اگر وہ اصلاح پر آمادہ ہوں‘‘۔
فَاِنْ طَلَّقَھَا فَلَا تَحِلُّ لَہٗ مِنْ؍ بَعْدُ حَتٰی تَنْکِحَ زَوْ جاً غَیْرَ ہٗ۔۔۔۔۔۔۔۔۔۔۔ (البقرہ۔ 130)۔
’’پھر اگر وہ (تیسری بار) اس کو طلاق دے دے تو اس کے بعد وہ اس کے لیے حلال نہ ہو گی یہاں تک کہ اس عورت کا نکاح کسی اور سے ہو جائے ۔۔۔۔۔۔۔ ‘‘۔
اِذٰا نَکَحْتُمُ الْمُؤٰ مِنٰتِ ثُمَّ طَلَّقْتُمُوْ ھُنَّ مِنْ قَبْلِ اَنْ تَمَسُّوْ ھُنَّ فَمَا لَکُمْ عَلَیْھِنَّ مِنْ عِدَّ ۃٍ تَعْتَدُّ وْ نَھَا (الاحزاب۔ 49)۔ ’’ جب تم مومن عورتوں سے نکا ح کرو اور پھر انہیں ہاتھ لگانے سے پہلے طلاق دے دو تو تمہارے لیے ان پر کوئی عدت لازم نہیں ہے جس کے پورے ہونے کا تم مطالبہ کر سکو‘‘۔
وَالَّذِیْنَ یُتَوَ فَّوْ نَ مِنْکُمْ وَ یَذَ رُوْ نَ اَزْوَاجاً یَّتَبَّرَبَّصْنَ بِاَ نْفُسِھِنَّ اَرْ بَعَۃَ اَشْھُرِ وَّ عَشْراً (البقرہ۔234)۔’’ اور تم میں سے جو لوگ مر جائیں اور پیچھے بیویاں چھوڑ جائیں تو وہ عورتیں چار مہینے دس دن تک اپنے آپ کو روکے رکھیں‘‘۔
ان آیات میں جو قواعد مقرر کیے گئے تھے وہ یہ تھے
ایک مرد زیادہ سے زیادہ اپنی بیوی کو تین طلاق دے سکتا ہے ۔
ایک یا دو طلاق دینے کی صورت میں عدت کے اندر شوہر کو رجوع کا حق رہتا ہے اور عدت گزر جانے کے بعد وہی مرد و عورت پھر نکاح کرنا چاہیں تو کر سکتے ہیں، اس کے لیے تحلیل کی کوئی شرط نہیں ہے ۔ لیکن اگر مرد تین طلاق دے دے تو عدت کے اندر رجوع کا حق ساقط ہو جاتا ہے ، اور دوبارہ نکاح بھی اس وقت تک نہیں ہو سکتا جب تک عورت کا نکاح کسی اور مرد سے نہ ہو جائے اور وہ کبھی اپنی مرضی سے اس کو طلاق نہ دے دے ۔
مدخولہ عورت، جس کو حیض آتا ہو، اس کی عدت یہ ہے کہ اسے طلاق کے بعد تین مرتبہ حیض آ جائے ۔ ایک طلاق یا دو طلاق کی صورت میں اس عدت کے معنی یہ ہیں کہ عورت ابھی تک اس شخص کی زوجیت میں ہے اور وہ عدت کے اندر اس سے رجوع کر سکتا ہے ۔ لیکن اگر مرد تین طلاق دے چکا ہو تو یہ عدت رجوع کی گنجائش کے لیے نہیں ہے بلکہ صرف اس لیے ہے کہ اس کے ختم ہونے سے پہلے عورت کسی اور شخص سے نکاح نہیں کر سکتی۔
غیر مدخولہ عورت، جسے ہاتھ لگانے سے پہلے ہی طلاق دے دی جائے ، اس کے لیے کوئی عدت نہیں ہے ۔ وہ چاہے تو طلاق کے بعد فوراً نکاح کر سکتی ہے ۔
جس عورت کا شوہر مر جائے اس کی عدت چار مہینے دس دن ہے ۔
اب یہ بات اچھی طرح سمجھ لینی چاہیے کہ سورہ طلاق ان قواعد میں سے کسی قاعدے کو منسوخ کرنے یا اس میں ترمیم کرنے کے لیے نازل نہیں ہوئی ہے ، بلکہ دو مقاصد کے لیے نازل ہوئی ہے ۔
ایک یہ کہ مرد کو طلاق کا جو اختیار دیا گیا ہے اس استعمال کرنے کے ایسے حکیمانہ طریقے بتائے جائیں جن سے حتی الامکان علیٰحدگی کی نوبت نہ آنے پائے ، اور علیٰحدگی ہو تو بدرجہ آخر ایسی حالت میں ہو جبکہ باہمی موافقت کے سارے امکانات ختم ہو چکے ہوں۔ کیونکہ خدا کی شریعت میں طلاق کی گنجائش صرف ایک ناگزیر ضرورت کے طور پر رکھی گئی ہے ، ورنہ اللہ تعالیٰ اس بات کو سخت ناپسند فرماتا ہے کہ ایک مرد اور ایک عورت کے درمیان جو ازدواجی تعلق قائم ہو چکا ہو وہ پھر کبھی ٹوٹ جائے ۔
نبی صلی اللہ علیہ و آلہ و سلم کا ارشاد ہے کہ مَا احَلَ اللہ شیئاً ابغضَ الیہ من الطلاق۔’’ اللہ نے کسی ایسی چیز کو حلال نہیں کیا ہے جو طلاق سے بڑھ کر اسے ناپسند ہو‘‘(ابو داؤد)۔ اور ابغض الحلال الی اللہ عزّ و جَل الطلاق۔ ’’ تمام حلال چیزوں میں اللہ کو سب سے زیادہ نا پسند طلاق ہے ‘‘۔ (ابو داؤد)۔
دوسرا مقصد یہ ہے کہ سورہ بقرہ کے احکام کے بعد جو مزید مسائل جواب طلب باقی رہ گئے تھے ان کا جواب دے کر اسلام کے عائلی قانون کے اس شعبہ کی تکمیل کر دی جائے ۔ اس سلسلے میں یہ بتایا گیا ہے کہ جن مدخولہ عورتوں کو حیض آنا بند ہو گیا ہو، یا جنہیں ابھی حیض آنا شروع ہی نہ ہوا ہو، طلاق کی صورت میں ان کی عدت کیا ہو گی۔ اور جو عورت حاملہ ہو اسے اگر طلاق دے دی جائے یا اس کا شوہر مر جائے تو اس کی عدت کی مدت کیا ہے ۔ اور مختلف قسم کی مطلقہ عورتوں کے نفقہ اور سکونت کا انتظام کس طرح کیا جائے ۔
اَطَّلَاقُ مَرَّتٰنِ، فَاِمْسَکٌ ؍بِمَعْرُوْ فٍ اَوْتَسْرِیْح؍ٌ بِاِحْسِانٍ (البقرہ۔ 229) ’’طلاق دو بار ہے ، پھر یا تو سیدھی طرح عورت کو روک لیا جائے یا بھلے طریقے سے رخصت کر دیا جائے ‘‘

’’پھر اگر وہ (تیسری بار) اس کو طلاق دے دے تو اس کے بعد وہ اس کے لیے حلال نہ ہو گی یہاں تک کہ اس عورت کا نکاح کسی اور سے ہو جائے ۔۔۔۔۔۔۔ ‘‘۔

وَالَّذِیْنَ یُتَوَ فَّوْ نَ مِنْکُمْ وَ یَذَ رُوْ نَ اَزْوَاجاً یَّتَبَّرَبَّصْنَ بِاَ نْفُسِھِنَّ اَرْ بَعَۃَ اَشْھُرِ وَّ عَشْراً (البقرہ۔234)۔’’ اور تم میں سے جو لوگ مر جائیں اور پیچھے بیویاں چھوڑ جائیں تو وہ عورتیں چار مہینے دس دن تک اپنے آپ کو روکے رکھیں‘‘۔
ان آیات میں جو قواعد مقرر کیے گئے تھے وہ یہ تھے
ایک مرد زیادہ سے زیادہ اپنی بیوی کو تین طلاق دے سکتا ہے ۔
ایک یا دو طلاق دینے کی صورت میں عدت کے اندر شوہر کو رجوع کا حق رہتا ہے اور عدت گزر جانے کے بعد وہی مرد و عورت پھر نکاح کرنا چاہیں تو کر سکتے ہیں، اس کے لیے تحلیل کی کوئی شرط نہیں ہے ۔ لیکن اگر مرد تین طلاق دے دے تو عدت کے اندر رجوع کا حق ساقط ہو جاتا ہے ، اور دوبارہ نکاح بھی اس وقت تک نہیں ہو سکتا جب تک عورت کا نکاح کسی اور مرد سے نہ ہو جائے اور وہ کبھی اپنی مرضی سے اس کو طلاق نہ دے دے ۔
مدخولہ عورت، جس کو حیض آتا ہو، اس کی عدت یہ ہے کہ اسے طلاق کے بعد تین مرتبہ حیض آ جائے ۔ ایک طلاق یا دو طلاق کی صورت میں اس عدت کے معنی یہ ہیں کہ عورت ابھی تک اس شخص کی زوجیت میں ہے اور وہ عدت کے اندر اس سے رجوع کر سکتا ہے ۔ لیکن اگر مرد تین طلاق دے چکا ہو تو یہ عدت رجوع کی گنجائش کے لیے نہیں ہے بلکہ صرف اس لیے ہے کہ اس کے ختم ہونے سے پہلے عورت کسی اور شخص سے نکاح نہیں کر سکتی۔
غیر مدخولہ عورت، جسے ہاتھ لگانے سے پہلے ہی طلاق دے دی جائے ، اس کے لیے کوئی عدت نہیں ہے ۔ وہ چاہے تو طلاق کے بعد فوراً نکاح کر سکتی ہے ۔

دوسرا مقصد یہ ہے کہ سورہ بقرہ کے احکام کے بعد جو مزید مسائل جواب طلب باقی رہ گئے تھے ان کا جواب دے کر اسلام کے عائلی قانون کے اس شعبہ کی تکمیل کر دی جائے ۔ اس سلسلے میں یہ بتایا گیا ہے کہ جن مدخولہ عورتوں کو حیض آنا بند ہو گیا ہو، یا جنہیں ابھی حیض آنا شروع ہی نہ ہوا ہو، طلاق کی صورت میں ان کی عدت کیا ہو گی۔ اور جو عورت حاملہ ہو اسے اگر طلاق دے دی جائے یا اس کا شوہر مر جائے تو اس کی عدت کی مدت کیا ہے ۔ اور مختلف قسم کی مطلقہ عورتوں کے نفقہ اور سکونت کا انتظام کس طرح کیا جائے ۔
